Supervisory Order On Appointment Of Mr. Milenko Milicevic To The Position Of Chief Of Police Of The Brcko District

In accordance with paragraphs 36(d), 37 and 39 of the Brcko Final Arbitral Award of March 5, 1999, and paragraph 6 of the Annex of August 18, 1999;

Considering Articles 34 and 60 of the Statute of the Brcko District;

Recallingthe resignation of Mr. Dusan Kokanovic from the position of the Chief of Police of the Brcko District of October 12, 2002;

Followingthe recommendations of the United Nation’s International Police Task Force to amend the Law on Police of the Brcko District and to de-politicize the position of the Chief of Police, as has been done elsewhere in Bosnia and Herzegovina;

Based on the fact that the Independent Selection and Review Board was established in accordance with the recommendations of the United Nation’s International Police Task Force and decided that Mr. Milenko Milicevic is the best candidate for the position of the Chief of Police of the Brcko District;

As a result of the failure of the Interim Assembly of the Brcko District at the session of February 7, 2003, to reach the three-fifths majority required by the Statute of the Brcko District for the appointment of Mr. Milenko Milicevic to the position of Chief of Police, after unsubstantiated claims and accusations against the candidate;

Following the confirmation of the Independent Selection and Review Board that Mr. Milenko Milicevic is still the best-qualified candidate, and the refusal of its members to compromise their independent and professional judgment by suggesting another candidate to the District Assembly;

With the aims of de-politicizing the Police of the Brcko District and strengthening their professionalism;

I hereby appoint Mr. Milenko Milicevic to the position of the Chief of Police of the Brcko District.

The mandate of the new Chief of Police shall be four years from the date of this order, and the terms of service shall be determined in accordance with the Law on Police as amended on February 7, 2003.

This Order shall have immediate effect and shall be published in the Brcko District Official Gazette.
